GREENBURGH TOWN BOARD TO VOTE ON AMENDMENT TO FINNERAN LAW TONIGHT AT 8 PM

GREENBURGH COULD RECEIVE 3 MILLION PLUS IN ADDITIONAL REVENUE IF THIS LAW IS CHANGED…

The Greenburgh Town Board is expected to vote on the following resolution at a special meeting tonight at 8 PM. If the NYS Legislature approves the amendment to the Finneran Law and if the town is able to rent out the tennis facility to a private company for use during off season months (when the tennis courts would otherwise not be used) the town could generate over $3 million dollars in additional revenue over the life of the 15 year lease. Additional improvements to our tennis courts will be made –at no cost to the town.

RESOLUTION REQUESTING THAT THE NEW YORK STATE LEGISLATURE AMEND CHAPTER 891 OF THE LAWS OF 1982 (“THE FINNERAN LAW”) TO ALLOW TOWN RECEIPT OF STATE AND COUNTY GRANT FUNDING, AS WELL AS TO PERMIT BOTH RESIDENTS AND NONRESIDENTS OF THE TOWN TO USE TENNIS FACILITIES AT ANTHONY F. VETERAN PARK, IN THE DISCRETION OF THE TOWN BOARD AFTER A PUBLIC HEARING

WHEREAS, Chapter 891 of the Laws of 1982 (“the Finneran Law”) is a state law which requires that all costs of the acquisition, construction, operation and maintenance of any public park, playground or recreational facility in the Town of Greenburgh be paid for by a levy of taxes only upon taxpayers residing in the Town’s unincorporated area outside of the Town’s six incorporated villages and that such public parks, playgrounds and recreational facilities be restricted in use to residents of the Town outside of its six incorporated villages; and
WHEREAS, the Town has received a proposal from a vendor to construct a recreational bubble over the tennis facilities at Anthony F. Veteran Park in the Town which construction would allow such Town tennis facilities to be operated year round, and in inclement weather, and is proposed to generate hundreds of thousands of dollars in annual tax revenue for the Town; and
WHEREAS, in addition to the additional tax revenue that the Town would receive, the proposal to bubble the tennis facilities would also result in several existing tennis courts, currently in disrepair, being completely refurbished and rehabilitated at no cost to Town; and
WHEREAS, in order to generate the tax revenue proposed, Chapter 891 of the Laws of 1982, would have to be amended by the State legislature to permit both residents and nonresidents of the Town to use the tennis facilities at Anthony F. Veteran Park, although nonresidents of the Town’s unincorporated area outside of its six villages would pay a higher admission fee than residents; and
WHEREAS, the Town also seeks to amend the Finneran Law to permit the Town to accept State and County grant funding for Anthony F. Veteran Park in the discretion of the Town Board after a public hearing; and
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Greenburgh hereby requests that the New York State legislature amend Chapter 891 of the Laws of 1982 (“the Finneran Law”) to allow receipt of State and County grant funding, as well as to permit both residents and nonresidents of the Town to use tennis facilities at Anthony F. Veteran Park, in the discretion of the Town Board after a public hearing.
