kathwood update...E HARTSDALE FLOOD STUDY, ELMSFORD RACEWAY, TWO MORE OUTDOOR MOVIES..CONCERTS

On Thursday, July 19, 2007, the Town Zoning Board of Appeals considered and denied a request from WBRC Corp., the owners of five unfinished homes on Kathwood Road in the Orchard Hill section of Town, for a variance to build a home on a sixth lot adjacent to the other homes. An application to the Zoning Board was required to develop the sixth lot because the lot is short of the applicable square footage (5000 sqft.) necessary to build a home in the R-5 zoning district. As a result, the owners of the unfinished homes must now return to the Town Planning Board to obtain final subdivision approval to receive permission to complete construction.

Previously, the Westchester County Supreme Court had ruled that the five unfinished homes could remain in their existing state until the Planning Board approved the developer’s plans for construction and development. However, the Planning Board’s review and approval has been delayed because (1) an environmental review of the property was required pursuant to SEQR and (2) and the Zoning Board had not yet rendered a decision on the variance application to develop the sixth lot.

Now that the Zoning Board has ruled and the environmental review is complete, the matter can be referred back to the Planning Board for final subdivision approval so that the unfinished homes can be completed. However, the owners of the unfinished homes do have a right to appeal the Zoning Board’s denial of the variance application and any appeal could further delay completion of construction.

EAST HARTSDALE AVEFLOOD STUDY: INTERVIEWS TOMORROW AT 4:15 PM–The Town Board will be interviewing 3 engineering firms interested in conducting a study for the town re: E Hartsdale Aveflood. The firm that is selected by the Town Board will also make recommendations. Many stores on E Hartsdale Avewere closed for many weeks due to the flood. We can’t afford another flood related disaster on the Ave and have to come up with a plan of action. The interviews will be open to the public and begin at 4:15 PM  GOOD NEWS—SIGN ON THE WINDOW OF THE BAKERY ON EAST HARTSDALE AVE SAYS THE POPULAR STORE WILL RE-OPEN AUGUST 1st. They have been closed since the spring storm.

POPULAR ELMSFORD RACEWAY MOVES NEAR MULTIPLEX THEATER, 342-344 SAW MILL RIVER ROAD, ,ELMSFORD. Elmsford Raceway’s Lou del Rosario has been a fixture in Greenburgh for many years. Mr.del Rosario and Elmsford Raceway have worked with Rotary International’s Gift of Life program and have helped many children who need another lease on life with free open heart surgery. This weekend Mr. del Rosario organized another charity race for gift of life recipients at his grand opening party. The raceway moved from North Payne Streetto Saw Mill River Road, - the same complex as the Greenburgh movie theater. Visit their web site: www.flatoutfun.com.

2 MORE OUTDOOR MOVIES  AUGUST 3RD AND AUGUST 10th—Celebrate Greenburgh Day was a big success. Over 1200 people enjoyed the days activities. A special thank you to the parks dept and dept of Community Resources for their excellent team work and planning efforts.  Many people enjoyed our outdoor movie, HAPPY FEET. This summer we’re sponsoring two additional movies in town parks –ARE WE THERE YET, at TravisHillParkon Friday August 3rd  and STOMP THE YARD, Friday August 10th at MassaroPark, Elmsford. This is the first year we’re sponsoring outdoor movies at Massaro and Travis.

The buildings will remain pending subdivision approval by the Planning Board. The Planning Board initially made an environmental review determination pursuant to SEQR. Next the Zoning Board considered whether a variance would be issued to build on a sixth lot and denied the request for the sixth lot variance. Now the Planning Board will consider how the proposed five lot subdivision will be developed. This matter will now return to the Planning Board for subdivision review.
