The Appellate Division reversed a decision by a lower court directing WBRC Corporation and Baker Roofing to demolish five partially constructed single family homes and restore the underlying property to its natural condition. The homes are located on KathwoodRoad. The petitioners had argued that the property is inalienable parkland which must be restored to its natural condition. As a result of the September 26, 2005decision the lawyers for the Baker Roofing company have requested that the Planning Board resume its review of the pending application.
